DPL Asesores books on Kindle

If you have come from one of the books, here is what it promised: the one-page map “What you pay in Spain and what you pay at home”, a short guide, the official sources the books rely on and how to write to DPL Asesores.

The books

All by DPL Asesores: general information in plain language, with the rules in force at the date of each edition. On Amazon, search for “DPL Asesores”:

The Spanish editions, with their covers and links, are on the Spanish readers’ page.

What you pay in Spain and what you pay at home

The one-page map from “Selling into Europe from a Warehouse in Spain”, for businesses from outside the EU with stock in a 3PL in Spain. You can download it and share it.

Map: what you pay in Spain and what you pay at home. The full text is below the image.
It is the general rule; the book and the short guide explain the exceptions. Download the map (SVG)

Spain, which follows the goods: customs duties and import VAT, in your name as the importer, with the import VAT recovered in your Spanish VAT return; Spanish VAT on sales in Spain (in your own store, you charge it; on a marketplace, on sales to consumers, the marketplace does); the VAT of each EU country on your store’s sales to consumers elsewhere in the EU, through the OSS in Spain from the first sale; packaging (producer registration in Spain and the plastic packaging tax at customs); and, as a general rule, a tax representative in Spain if your business is established outside the EU.

Home, which follows the company: tax on your profits, as a general rule, while you have no permanent establishment in Spain; no Spanish withholding on your sales, with a tax treaty and no permanent establishment; your owners’ taxes and your country’s rules; and, for a US LLC taxed through its members, the Spain–US treaty only protects the share of the members taxed in the US as residents.

Careful, these can create a permanent establishment: space in the warehouse at your disposal; someone in Spain who habitually signs contracts in your name; assembling or processing the goods here with your own means; a related company in Spain that does part of the business; running the company from Spain, which is a question of residence. Hiring staff in Spain changes the analysis of the permanent establishment.

The short guide

“Stock in a 3PL in Spain as a non-EU seller: what you pay in Spain and what you pay at home” summarises the book: registration, the tax representative, customs and import VAT, your own store versus a marketplace, packaging and profits, with questions and sources.

For online stores and marketplace sellers, there is more in the website’s tax guides.

The guides with their spreadsheets

The chapters of the selling-online, EPR and tax-basics books come from DPL Asesores’ tax guides. In The Arsenal, the website’s shop, each guide comes as a PDF with its spreadsheet, which the books do not include.

The official sources

The books rely on the law and on official guidance. The main sources, with their links:

If your case does not fit the books, describe it in writing on the contact page: what you sell, from which country, where your stock is and through which channels you sell. DPL Asesores provides advice and consulting: it analyses the case and sets out what to do, how and in what order.

General information, not an analysis of your case. The books and the guide reflect the rules in force at the date of each edition.
